Like all the other warrants, this one is pretty straight-forward. It claims that on or about December 18, 2013 Sidney Moorer “did unlawfully, without just or sufficient cause did murder Heather Elvis with malice aforethought.”
The mandatory sentence for murder in South Carolina is 30 years to life in prison. The prosecuting attorney can also request the death penalty if there are aggravating circumstances. As of now, the solicitor in this case says he does not plan to seek the death penalty. That could change as additional information is discovered.
Keep in mind that “malice aforethought” is the same as what most of us consider “premeditated.” What this means is that the State of South Carolina is accusing Sidney Moorer of planning to murder Heather Elvis. This carries more serious penalties than other types of murder.
